Claims handling is an integral and core function of AP &L Consult Limited operations.
– We provide efficient handling and processing of claims to our Clients to ensure
prompt and fair settlement.
– We assist our Clients with the preparation of claims supporting documents
including completion of claims forms.
– As Lawyers, we offer policy interpretations to ensure fair settlement of claims
– We liaise with various relevant professionals such as Accountants, Mechanics,
Engineers and Quantity Surveyors in adjusting the claim.
– We participate in the appointment of Loss Adjusters for the claim.
– We negotiate for the most favorable settlement, ensuring that the claims are
settled promptly.
MOTOR CLAIMS
Who is entitled to make a claim?
- The insured (policy holder)
- The third party whose property has been damaged by our insured’s vehicle
- The injured victim
- Administrators of a deceased estate
- Parents/guardians in the case of minor
Motor Claims Procedures are as follows:
- Report all accidents to the Police.
- Report the accident to your Insurers or Brokers and fill the relevant claim form.
- Do not settle, negotiate to settle, admit or repudiate any claim without the Insurers consent.
- Forward all relevant documentary evidence in respect of the loss to your Insurers or Brokers.
- Forward all claims, writs of summons or letters from third parties to your Insurers or Brokers unanswered.
Relevant documentation required when liability has been fully established:
- Own damage
- Report the loss to the insurer and fill the accident report form.
- Attach a copy of the driver’s license.
- Furnish the insurer with an estimate of the cost of repairs from either the insurer’s recommended garage or a repairer of your choice.
- Provide pictures of the damaged vehicle, clearly showing the registration number of the accident vehicle.
- Allow damaged vehicle to be inspected by the insurer’s surveyor before the commencement of repairs.
- Police report may be required, depending on the circumstances leading to the accident.

- Sworn Affidavit
- Two (2) passport-size pictures of the injured victim endorsed by the doctor who treated the victim.

- Death Certificate/Burial permit/Post-mortem report
- Letters of Administration
- Personal Particulars of the deceased
- Sworn Affidavit
- Endorsed passport size pictures of Administrators (two each).
Period within which to make a claim:
- Injury/death – up to three years from the date of the accident.
- Damage – up to six years from the date of the accident.
Some circumstances under which your motor claims will be repudiated
- If your vehicle was driven without your consent, order or permission.
- When an unlicensed driver was driving
- When the claim is statute barred, that is, claims not submitted within the three (3) or six (6) year period.
- Where there was a change of ownership on the vehicle without reference to your Insurers.
- Using the vehicle whilst the driver was drunk.
- Using the vehicle for unauthorized purposes.
NON-MOTOR CLAIMS PROCEDURES;
Non-motor insurance comprises of several lines example public liability, professional indemnity, personal accident etc. Each non-motor insurance
claim has its own specific claims procedure and conditions which are explained in detail by our competent and well trained claims staff whenever a claim is made.
Generally, when an accident occurs, the insured (policyholder) should comply with the following,
- Report the incident to the Police or Fire Service (in case of fire).
- IMMEDIATELY contact the insurers and complete the relevant claim form.
- Take all reasonable steps to protect the damaged site/property for inspection by the Insurers
- Do not settle, negotiate to settle, admit or repudiate any claim without your Insurers consent.
- Forward all relevant documentary evidence in respect of the loss to your Insurers.
- Forward all claims, writs of summons or letters from third parties to your Insurers or Brokers unanswered.
CLAIMS INFORMATION
In the event of having to report a claim to us please notify us on 01702 225 440 during normal business hours or email us as soon as possible.
To enable any claim to be dealt with promptly please provide the following:
- Insurance policy or Certificate of Insurance
- Statement of claim – explanation of loss, extent of damage etc
- Commercial Invoice
- Packing List
- Bill of Lading (goods by sea) / Airway Bill (goods by air) / Consignment Note (goods by road)
- Delivery Receipts
- Notice to Carriers – Depending on how the cargo was transported a general guideline is as follows
Shipping Line: Within 3 days from the time of delivery.
Airline: Within 14 days from the time of delivery
Road: Within 7 days from the time of delivery.
